Re: 50/50

"50/50" usually refers to the parents have equal periods of physical placment with their minor children. There is no legal meaning to "50/50" and it is not used in the placement statutes at all. There is no right in Wisconsin to "50/50" placement of children. Child support is determined by the amount of time each parent has the children taking into consideration the income of each parent if each parent has the child greater than 25% of the time. There is often a child support order when each parent has the children for 50% of the time due to the disparity in the the parents incomes. The IRS Code provides the rules stating which parent has a right to the dependency exemption though Wisconsin law may shift the right from parent to parent. In practice, sharing of the dependency exemption is common. Wisconsin courts can make orders concerning transportaion arrangements and orders. Equalizing the burden to each party is common though there are exceptions.
