Legal Question in Family Law in Arkansas

Paternity and sole custody
My fiancee and I are expected to be married this year 2009. He has a 3 year old son. A few weeks ago he was notified via mail about CS. He has no receipts to date, regarding payments sent. But has been paying CS off the record. They lived in different states until 4 months ago. We've been keeping the child since every weekend upon his arrival. We recently found out that she abandoned the child and has been using drugs. We have always been aware of her drinking habit, but thought she was better. Maternal grandmother has child now. She informed us that whenever we got legal matter cleared we can get child. What are his right,and should we go ahead and seek legal counsel. He wants custody... sole)
