Power of Attorney

My son is Mental Retarded. He just turned 18 years old. He is still in High School. His full scale IQ is 49 Verbal IQ 52 Performance IQ 53. He is high function and can understand somethings.He will not be able to understand how to complete his IEP, how to ask for help if his IEP is not being followed. Can he give me power of attorney to take care of his education needs until I can get Legal Guardianship over him?

You may want to do a limited power of attorney for education purposes but you should also be able to get a guardianship fairly quickly also.

If he is legally incompetent, he may not be able to give you power of attorney without a court order. I would like to ask a couple of more questions to be sure.

But it may be best to just get a general guardianship of him. If no one else objects to that, it may not be too difficult.
