Legal Question in Family Law in Arkansas

I have a surrogacy contract and the baby has been born. 2 months old I am wanting her name removed from the birth certificate and only mine listed (the father). Is that possible? My husband will place his on the birth certificate as soon as our law suit with our state (arkansas) issues a ruling in our favor or when the US Supreme Court rules. How do I accomplish this? I have an attorney but its the same one my surrogate used in the formation and execution of the contract. I want to make sure I am being told all my options. Surrogate is supposed to sign away guardianship and power of attorney but she is making my feel as if she isn't going to follow the contract. I just want her name off the birth certificate and mine be the only one on there for now. Can I do that and how?
