Legal Question in Civil Litigation in Arkansas

Motel security

While vacationing in another state, my son's locked pick-up was broken into and his radio, speakers, amplifier, and other assorted items were stolen. When this incident happened, the truck was parked at a motel. The only security camera was at the back of the motel. Can the motel be sued for a lack of sufficient security?

Re: Motel security

Probably not, but it depends what state he was in at the time. It will also depend on a lot of other facts, such as whether there was reason to believe crimes were likely in this location. Ordinarily, there is no duty to have security cameras at all and the lack of such a camera can only be grounds for liability if the particular facts of the case make it appropriate to demand that such a camera be in place.

The standards for such a decision will vary from one state to the next. You aren't clear which "other state" your son was in when this happened; you should consult with an attorney in that state -- and, in fact, in the area where this occurred.
