Insurance not paying

On June 15th I took my Chevy S-10 pickup truck to Wal-mart for regular oil change. After they changed the oil, they parked the car in the parking lot, and then a Chevy Tahoe (driven by M) hit my truck. I was paged in the store, and then we changed the insurance papers. Then I filled the paperwork and took them to the police station. Wal-mart people told me what happened and they said they have the surveillance tape of this incident which shows this is clearly Mr. M�s fault.

I called my insurance (State farm) and told them the story and did the same thing with Mr. M�s insurance (Progressive). I filed a claim with Progressive. My insurance advised me to ask the surveillance tape from WM. I asked the police and they got the tape and they send the tape to my insurance (State farm) and they have sent the tapes to Progressive. (twice, they claimed first one got lost). I have tried to contact them 10-15 times, and they don�t give any answer. They did send me a letter that this case is closed, because they have no evidence that it�s Mr. M�s (their client) fault even though everybody including WM, police and my insurance agrees it�s their fault. What I can do in this case. Please advice
