Doctor lied about procedure

I had a Laproscopic surgery in 2004 and my doctor told me that he was going to do an HSG at the same time, after the surgery he told me that my tubes were clear. My husband and I have been trying to conceive ever since, thinking that my tubes were clear, well I went to the hospital to get the records from the HSG and the hospital says that they have no records that he ever did that procedure. He told me that he did and that my tubes were clear. I have spent thousands of dollars trying to conceive and now I find out that my tubes may have been blocked all along. Is this malpractice and is there anything that I can do about this?

If you are saying you paid for a surgical procedure you thought occurred, but did not, the type of case you might have, would sound in the area of "contract law" "Breach" "Fraud" etc..

If you are saying the surgeon's job was inadequate or deficient, then the case you might have would sound in "malpractice."

However, whether malpractice or contract law, it is Torts and the relief you would be entitled to request is money, for your proveable damages.
