Legal Question in Medical Malpractice in Arkansas

medical malpractice law

About 5 years ago my sister went to see a phycatrist for depression & had been under this dr.'s care until she passed away. This doctor not only had her on 12 different pills that turned my sister into a different person, On June 28 she went into the hospital for a biopsy, according to her doctor that did the biopsy she should have been up & in a chair watching t.v. the next day. The doctors at the hospital said that they didn't understand how a person could be on so many different antiphycotic drugs, they didn't know how to regulate the drugs, her dr. that did the biopsy said that this is why my sister had problems with recovering from the biopsy, from this I lost my sister at the young age of 46, my sister had this phychiasrist as a benefecry on her life insurance policy. I want this dr. to be looked at by the state bar. how do I go about ding so? Please excuse my mispellings, I am very frustrated, hurt & lost.

Re: medical malpractice law

you can file a grievance with the state board that regulates physicians and other medical professionals, and you can also consult with a lawyer regarding a possible malpractice claim. In order to even file a medical malpractice lawsuit, you have to retain an expert in the same field as your sister's treating physician to review all the medical records and provide an opinion that your case has merit. This can cost up to $10,000 - and that is just for expert services before you file the lawsuit. This does not guarantee that you will ultimately win - it just a procedural requirement in Michigan to prevent people from filing meritless lawsuits against medical professionals.

do you know when she obtained the life insurance policy, or when she changed the beneficiary to her doctor? that strikes me as odd, however, if she was influenced by the drugs, she may have considered him her savior and/or trusted friend.

you can also search the state's website to see if there have been any other complaints against the doctor.

if you would like to discuss further, please contact me during regular business hours.

sorry for your loss.

thank you.
