Legal Question in Personal Injury in Arkansas

2 of our clients were on the news and made very false statements. They were not opinion. They shared we had not delivered product that they have in their possession. We have paper work to prove this.

The news channel did not contact us before running the story.

They lead the viewer to believe that we had stolen $$ from our clients.

This was not true.

Do we have a case for defamation?

What was the news program's responsibility to contact us -- they had our number on the letter we provided to the client - -- and did not call?

How do we get a retraction -- our family saw this and called very distraught?

You probably have a claim against the clients, but you probably don't against the news channel. If the report said only that the clients made these claims then it was accurate. You might have a case against the channel if the report said the claims were true.

The reporter or editor probably should have called you before running the story, but that is a matter of ethics and professional responsibility. They did not have a legal duty to call you, especially if they did not report that the clients' statements were true.
