Legal Question in Real Estate Law in Arkansas

Disclosure

We purchased a home and had an inspection and disclosure done prior to closing. The home had some minor visable ceiling mold and we were told that it was due to a roof leaking. We had the roof repaired and the cost to repair was part of the closing agreement. The previous owners disclosed a leak from the water heater. We have recently begun to renovate and have discovered that there is mold in the subflooring and the walls of the surrounding area. According to the neighbors, there was a broken pipe and water leaked in the home for about a week. This was not disclosed and we feel that either the agent or previous owner were dishonest. The entire kitchen floor and possibly all cabinets will need to be replaced. The approximate cost is $25,000 to redo the kitchen. Do we have any legal recourse to help with damages? Louisiana allows you to sue a seller in redhibition under certain circumstances. I cannot advise you of the law in Arkansas. Whether you can sue the seller in redhibition in Louisiana depends on numerous circumstances, especially whether the seller was also the builder. You should consult with an attorney to determine your rights as soon as possible.
