fence on someone elses property

We have just been notified that a fence on one of our investment properities is on someone elses land. Do we have to move the fence? Is there a certain amount of time that would exempt you from moving the fence?

The answer to whether you have to move the fence is "it depends." There are a lot of facts that have to be evaluated in order to give advice specific to your case.

It is possible that if the fence has been there long enough (7 years) then you may have an adverse possession claim.
