Legal Question in Veterans Law in Arkansas

VA misdiagnosis upon eval

The VA diagnosed me with only a broken ankle bone upon discharge 8 years ago but i remembered the Navy dr.s telling me about a soft spot that had promed in the bone as a result. The VA has denied i ever even had a test done for this but I've finally found the civilian med ctr that did the tests and they are sending me copies of my records they have. What, if anything, can I do about this. I'm already pursuing increased comp., but is it possible to get a further backdated increase now that the magically disappearing records have been found?

Re: VA misdiagnosis upon eval

You may be able to get benefits back to an earlier date, but it just depends on what is in your file. Be sure you have a complete copy of your VA Claims file and service medical records. I may be able to help further after the holidays. You can email me directly at [email protected] with any further questions. Thanks for your inquiry and good luck.
