Legal Question in Wills and Trusts in Arkansas

My mother recently passed away and I am her only child. She has been separated from her husband for at least 5 years (he abandoned her) and I am not sure if she is divorced. There isn't much of an estate left, but I do know she wished for me to inherit her vehicle even though no beneficiary was named. Will I be able to take possession of the vehicle without proof of divorce?

The best way (if her estate qualifies) is a Small Estate Affidavit. You can file and then you have the authority to sign the car over to yourself. Under Arkansas law kids inherit first when there is no Will. The spouse can force their share if they wish. You can check the court records to see if she was divorced.
