Legal Question in Wills and Trusts in Arkansas

Widow's Rights

My father has recently passed away and my stepmother has decided to stay in their current residence based on her Window's Dower Rights. Prior to their marriage they met with an att. and elected to keep all prior assets separate which would have included my father's estate ie hm, land, cd's etc...Under his will I am his sole heir. What rights am I entitled to his property and what are my financial responsibilities to her as it relates to providing a hm.

Re: Widow's Rights

Your situation is complex and can't be answered without some additional information.

Specifically, you state that your father and stepmother "agreed" to keep all assets separate. Is this in writing? Was it signed by both parties? Do you have a copy?

This is important to the evaluation of your case. If there is not writing or no agreement, then you may not be the "sole heir" under the will.

I would suggest that you contact an attorney in your area for futher assistance. Good luck.
