NEW FERRIES Ltd operates a tourist ferry with rides around Sydney Harbour. Tickets for the ride are sold at a counter at the wharf and on the ticket there is a note which says �Issued subject to conditions. See signs for details.� As passengers step onto the ferry there is a sign listing eight conditions. The fifth condition exempts NEW FERRIES Ltd from liability for injuries on the ride.

Jane, a tourist from Great Britain, was keen to see the harbour as it was her first time visiting Sydney. Although she saw the note on the ticket she did not read the sign. There is an accident and Jane is injured.

For the purposes of this question assume there is no negligence on the part of NEW FERRIES Ltd or its employees.

(a) Under the law of contract, is NEW FERRIES Ltd protected by the note printed on the ticket and/or the sign?

(b) Would your answer be different if Jane had been on the ferry on a number of occasions?
