What are the processes by which remedy can be sought

Amantha is a 19 yrs old woman who is currently living in private rental accommodation having moved from a previous address 3 months earlier. At that time the tenancy was in her name, although she shared the house with a girlfriend and the girl�s boyfriend whose names also appeared on the tenancy agreement. At the time of leaving Amantha�s tenancy had reverted to a periodic tenancy.

While holding down a job, Amantha has a mild intellectual disability and has little confidence in herself.

The managing agent for her previous address are refusing her bond money and moreover are seeking $1500 dollars from her for damage to the house. They argue that as the tenancy was in her name she was liable for the damages. They have initiated action to claim the money through the magistrate�s court. A Property Condition Report was not completed either by the Managing Agent or Amantha. Amantha argues that before leaving she had been to the managing agents and advised them of her intention to leave and asked them what she should do. They advised her to write and tell them of her intention to leave and that the remaining tenants were interested in taking the lease over.

Amantha did this and has a copy of the letter dated 6 weeks before her

there say is correct you can well withdraw your participation in contratc by issuing notice of approrpiate period
