Can a Bank go to the forum of N.I. Act Section 138 for recovering its loan?

It doesn't matter if it is for loan or any thing else, if a cheque is dishonoured s 138 of N I Act will be applicable. Loan default and offence under s 138 are two different things. The bank however wouldn't be able to recover twice.
