Legal Question in Criminal Law in Bangladesh

my brother gave a blank cheque to her wife for family expenses as he was going to Bangkok for treatment after one month he returned and asked about the cheque. then the wife said it is in my drawer, i will give it to you later. then my brother totally forgot about that. after one year they got divorced. and after divorce the ex wife filed a case against him about Negotiable Instrument ACT 1881. she said my brother gave her a cheque an amount of 59 lac taka, it was dishonored, she owes it. everything is lie here. my brother has the sign only bt date, amount everything was written by her. so i want to knw it is valid to sue the husband after divorce? any suggestion else?

Unfortunately, there is very little that can be done at this moment. Dishonour of cheque is an independent offence by itself, irrespective of the reasons for issuing the cheque. You can ask for a stay of the proceedings from the High Court if the proper procedure has not been followed, otherwise not much can be done.
