Arrested For DUI With an Injury During Accident-Questionable Insurance Coverage

Recently I was involved in an accident which I was responsible for. I exchanged license plate #'s w/the other driver and went home. Approx. 2-3 hrs. later an officer came, tested my BAC, and arrested me for DUI w/BAC above .08%. First, I scheduled an appt. w/the DMV for a hearing about my license sus.-to contest it. Now my wife tells me that we possibly weren't covered for ins. because we missed 2 pyments,(its monthly)-is that automatic suspension no matter the outcome of my DMV hearing? What step should I take next? I'm making car payments-was told my financer(holder of title) has 'backup' insurance on my car. Do they? Should I call them, my insurance, cancel hearing w/DMV, find out if the injured party can sue me & my wife if we're not insured? Run to the nearest lawyer?? How much trouble could we be in with the insurance lapse?

Re: Arrested For DUI With an Injury During Accident-Questionable Insurance Cover

The insurance portion of the inquiry is certainly a concern, but really minor compared to the DUI implications of the accident. With a BAC of .08 or greater (many times .08 is what is always written on the citation) an attorney is absolutely needed. The possible ramifications of this individuals actions are DUI charges, driving privileges suspended, fines, etc. Please call (800) 382-3100 for additional information and immediate assistance.
