Legal Question in Immigration Law in California

h1b visa

I got my H1B visa applied through company A. I'm outside U.S in my home country to have an interview with the U.S embassy to get my visa stamp. However, recently, company A decided not to hire me back.

I got another offer from company B. They are willing to sponsor me with H1B. Can company B apply for my h1B without having problem with the quota? (I never work for company A before).

Hi,

You must document very carefully the transfer file in order to avoid any problems at the Consulate in your home country. I had a similar case where the US Embassy asked for proof of employment, we supplied the contract of employment and it was fine.
