Legal Question in Real Estate Law in California

Landlord and manager change

The apartment complex were we live has a new land lord and we have a new manager. Preveousely we had two parkings, and now they raised our rent by $45, and took one of our parkings. They say we can rent it back for $25 additional a month. Is there anything we can do.

Re: Landlord and manager change

A new landlord and/or manager would have to observe the terms of any lease, but you don't say whether you had a long-term lease or only a month-to-month rental agreement. If the latter, the rent and other terms can be changed by 30 or 60 days' prior notice. 30 days if the net effect is a 10% or less rent increase; 60 days if the increase exceeds 10%.

If you have a lease, check if the 2nd parking space is listed as part of your leasehold interest.

Also, depending upon where you live in California, the actions by the new landlord may be subject to rent control. Read your lease, and find out about rent control in your city. Good luck!
