Legal Question in Disability Law in California

I would like to know about conservatorship. My oldest daughter lives in a board and care home. They allowed her to leave the home on a visit with my sister. I feel the home should have contacted me before allowing her to go. The home does not know my family and issues involved with my family. My daughter is mentally disabled,has seizures,lupus and mental health issues. She does not have any property or monies. She recieves SSI Benefits. She was diagnosed with disabilites when she was 5 yrs old. Would conservatorship prevent a person from picking her up, especially when they do not know how to care for her. She lived with me until she was 32 yrs old. How would I apply for conservatorship if needed? She is also with Regional Center in San Bernardino.

You have to petition the court to be appointed conservator of the person for your daughter. Being the conservator of the person will give you the authority to control where your daughter lives, who she sees and to make health care decisions for her. The process involves a lot of paperwork and you should consult an attorney regarding the process so that it is done correctly and quickly.
