Legal Question in Disability Law in California

My daughter has add and is currently on a 504 mod and she has an iep these are not being followed by the teachers, and the are stonewalling us about making it work for my daughter. i do live in so cal sandiego HELP!!

I can certainly understand what you are going through, and you have every right to demand that the IEP be complied with. While I'm not excusing it by any means, school districts are facing enormous budget crunches that have caused massive layoffs and cutbacks in programs. Classrooms are being doubled up, and the professionals who would take steps to assist you and your daughter might no longer be working there. In any case, you should speak with a lawyer in your area who specializes in these kinds of issues for more guidance. Sometimes a letter and/or phone call from an attorney might do the trick to get the school and district to do what is required.

I am sorry to hear that the school is not being responsive to your daughters special education needs. Typically, the IEP is reviewed at least once a year. However, if you believe that your daughter isn't making progress a meeting should be scheduled to address and revise the IEP. I would suggest that you put your request in writing and send it to the school and/or district administrator.
