There is not enough information here in this question, but to be honest, it sounds like someone is searching for a way around the system. This could result in this someone being accused of fraud and having to pay back the disability payments.

Disability is defined differently, depending on which law you are talking about. For example, to receive disability benefits under SSI, you must be able to show you cannot perform any work for 12 straight months. But, under the ADA, you may suffer a disability but ask your employer to allow you to continue to work, if they provide reasonable accommodation to allow you to perform the essential functions of your job.

But you have to be careful, if you make misstatements to receive benefits you can be criminally prosecuted.
