Legal Question in Disability Law in California

Disability Benefits

I have been a Tech for 18 years and have worked steadily for the majority of that time. 2 months ago I woke up with a speech impairment, Since then I have been undergoing tests to determine what caused it As my job was part time, I am collecting a very small disability from the state. It looks like now that I might possibly be impaired permanently. In my job capacity I communicated with doctors and nurses about drug orders and preparation, I can no longer do this and be understood. I cannot work as a result. Would I be entitled to Social Security because of this, as I have paid into it all these years?

Thank you.

Re: Disability Benefits

You have a number of rememdies, social security being only one of them.

Social security law is a specialty. You can contact your local bar association referral panel for names or simply make an application yourself. Please be aware, however, that it is a lengthy process and frequently applicants are rejected the first time and require an appeal. You should do so immediately, however, because the date of the commencement of your benefits is the date of your application.

YOu should also inquire whether your employer has a group disability insurance plan which covers you. YOu can also apply for California's disability.

Finally, you can request an accommodation from your employer. IF you have not already done so, you should meet with your human resources representative and tell them you want an accommodation, which means a modification of your work.

Good luck
