As with any problem, put the company on notice [in writing/memo] of the claim and requested solution. Contact HR or mgmt and try to talk and resolve. If no appropriate remedy is taken, then you may have the grounds for suit. Contact an attorney to discuss the details before you initiate the discussions, to make sure you are correct and informed about the law and your rights. Many people think they know the law, few do.
