Legal Question in Disability Law in California

work comp

I was hurt on the job.had surgey.and went back to work limented..I then was hurt again..the same hand and had to have surgey again..is my job protected..the time span was less than 90 days..they are saying i was not protected under the works comp law because i have not worked for a year..between surgys..

It's certainly covered by workers comp -- what it sounds like your employer is saying is that you have no more family medical leave time left -- that may or may not be true -- it depends, in part, on what's written in your employment manual. Even if you have no family/medical leave left, the employer is required to accommodate your disability -- which could include giving you another leave of absence.
