my dad passedid when I was 12 and my uncle (his brother) fought my stepmom for a trust fund for my sister and I but according to my uncle I have no access to that money unless he gives it to me.

how can I get around this and get my money?

(1) How old are you now?

(2) Do you have a copy of the instrument that established the (supposed) trust?

(3) What was the nature of the fight between your uncle and your stepmom, i.e., was it in court?

(4) Are uncle and stepmom still around?

(5) What is your sister's position in this?

(6) Is there any indication that your uncle has squandered your trust?

I recommend that you see a local wills, trusts and estates attorney for an initial (usually free) consultation, taking with you any documents you might have re the creation and/or existence of the trust, your father's will, any death records you may have, and any documents regarding the fight. The law provides substantial protection for the beneficiaries of trusts and imposes serious duties upon trustees.
