Legal Question in Appeals and Writs in California

Car Accident Law Suit

I was involved in a car accident in 1998 with a car that I purchased two days before the acident. I paid for insurance, but did not noticed that the insurance given to me by the dealership only covered my car. The accident was minor, and the other car did not even get a dent. I received a letter from DVM stating that they had canceled my driving privilages until I pay in full or make payment arrangements for apprx. $25,000. Aparently, I lost the case, but I was never personally served or was aware of the case. I need to get my driving privilages back and see if I can fight this case based on the fact that they did no t personally served me.

You should immediately notify the insurer you had before you bought the car - you get 30 days free coverage for newly acquired vehicles. The insurer might get an attorney to fight the default judgment wherein you say you were not notified. I would do this all immediately, since you only have a short time to try to set aside a judgment/default after you have notice of what happened. You should also order a complete copy of the court file so you can see how this occurred.

If you were not served you may be able to bring a motion for relief from default. You must act quickly, however. If you are in the southern California area, feel free to contact me.
