If you're in LA County, the court limit on fees are $4,000 for individuals and $4,500 if you own a business. To that you need to add costs, such as the filing fee, credit report, and credit counseling.

Attorney Starrett is correct, given that you are located in the Southern District of California. Attorney Shem-Tov is in LA, which is actually a different bankruptcy court district, and fees are allowed to be higher there. The fees he quoted are the maximum fees an attorney can charge in consumer ($3,300) and business ($4,000) in San Diego before the court will make the attorney explain why his fees are higher than the approved maximum. What that means is there are cases where the fees can exceed the maximums, but there needs to be an explanation of why. Good examples include people who may be self-employed in several businesses, complex issues involving lien stripping, etc... Its always a good idea to get a second opinion if you feel uncomfortable with what another attorney has quoted you. Good luck.

In San Diego County, the court allows a "presumed reasonable" fee of $3300 for consumer cases and $4000 for business cases. Hard costs are extra such as the credit counseling, credit report and the $274 filing fee and usually run aroudn $500. If you are trying to strip a lien from your home, add about $450 for a professional appraisal.

Most attorneys in San Diego will request 50% of the legal fees and all of the hard costs before filing your case. The remaining fees will generally be paid through the plan if confirmed by the Court.
