Chpater 13 saving my home

1. I have been late on my mortgage for a year now and it hasnt been foreclosed yet. Last year I applied for modification and was denied then I decided to short sale the house, there was a buyer and now she recently backed out Since Obama is having these law that maybe I can save my house that why I want to file for chapter 13. I was going to file chapter 7 and was ready to file this week but I heard that this buyer backed out and today I just sent a modification letter to my bank maybe theres a chance to modify it. As far as I know my realtor said it was on review for short sale. but I really want to keep the house. can chapter 13 help me save my house since it hasnt been forclosed yet? what happens to the past due payment? I am planning to modify the payment because it went up because they advance my property tax. it went up so high. I saw an article about HR 3609? what difference between Hr 200 that hasnt been signed yet? Will any of these help me save my house? under chapter 13
