Legal Question in Bankruptcy in California

Can Circuit City come after us for a reaffirmation that was not valid?

In 1996 I filed for bankruptcy and reaffirmed a debt with Circuit City. Later I joined a class action lawsuit against Circuit City that claimed that they had not acted appropriately in cases of reaffirmations during bankruptcies. We received a refund from Circuit City for monies paid after the reaffirmation and we assumed the debt had been canceles. Now 6-7 years later they are demanding that we pay them over $3,000 in debt that was part of the reaffirmation. Can they do this?

If you were not represented by a lawyer, a reaffirmation agreement has to be approved by the court. I'm not sure what you mean by "not valid". If you wish, you may e-mail me directly and explain further. Thanks. -Robert F. Cohen, Esq.
