Legal Question in Bankruptcy in California

creditors

I need to file for bankruptcy because of my debts. I have a lawsuit pending from an automobile accident that I am sure to win. Will bankruptcy affect that money when I get it.

A portion of the proceeds from the lawsuit may be exempt under California law (if it's for personal injury). The answer to your question depends on the amount you expect to receive and for what specific damages.

To the extent that your award in the auto accident case is for personal injury, it should be exempt up to $17,425 under Cal. Civ. Proc. Code � 703.140(b)(11)(E).
