Legal Question in Bankruptcy in California

Is ex-husband responsible

My husband and I were divorced in 2000, and in 2002 I filed bankrupty. I was discharged of all my debt by the fall of 2002. In May of 2005, my ex-husband was contacted by a creditor listed on the bankruptcy, saying they were suing him for the balance. Being divorced and most of the debts in my name, could he be held responsible for this?

Your husband should contact a lawyer. If repayment on the debts (which predated the divorce) did not begin by the dates they were due, there might be a statute of limitation issue on the lawsuit. I know of one credit card company that sometimes will claim there's been payment within the past 4 years to keep the 4-year statute of limitation open.
