Legal Question in Bankruptcy in California

Mortgage Bill HR 200

I have just filed a chapter 7 bankruptcy. When I was in my Atty's office he was looking at my house payments and said that if HR 200 goes thru the senate I can come back in and get my house lowered to the actual value which is quite a bit less that I owe. He said you can have more than one banktuptcy. Does that mean that if I file my chapter 7 and it goes thru, and the law passes I can go back and file a chapter 13 for the home loan. Pending the passing of HR200 of course.

The mortgage modification provisions that are proposed in HR 200 can only be accomplished in a Chapter 13 bankruptcy. If HR 200 passes in the its current you might ne able to convert your Chapter 7 to a Chapter 13 or file a new Chapter 13 case. The legislation could change or not pass at all.
