Legal Question in Bankruptcy in California

Refinancing home mortgage during chpt 13

We have began a refinance of current home mortgage with chpt 13. this will enable us to payoff all rears and get lower interest rate. Our current lender is out of state, and claiming we are in default of monthly pmts. We have sent photo copies of paid cashiers checks by ceritfied mail, and yet they still claim they never received them. Our original b/k attorney wants nothing to do with this without paying more money. The mortgage attorney has been working with us to try to resolve. We have missed two windows of payoff deadlines, because the mortg. company not re-searching the error. This is costing us more money due to interest on loan. What else can we do? This has been going on since Aug 2003.

Go to the bank where you got the MO's and ask for copies. This should help.
