Air Charter Brokerage Liability

I want to start a helicopter charter brokerage aimed at realtors who will show

their clients potential properties from the air. The realtor would contact me

and I would then arrange the flight with a local helicopter company. My only

involvement will be brokering the flights. Would I need more than a hold

harmless agreement with the realtors and the helicopter companies that

would eliminate my liability in the event of an accident or would I be liable

and need some sort of insurance policy?

You NEED insurance. Even with a hold harmless, you should have insurance. I would consult an attorney who has experience in insurance. You should then consult someone who has experience in aviation law. A good hold harmless is a start, but it is not foolproof. There are several things you need. Is such viewing from a helicopter permitted over residential areas? How close can the helicopter get? Well, these are just basic business plan and due diligence questions. You will need to create a business entity that will provide you with limited liability. You will then need to obtain insurance and have a hold harmless/release of liability agreement drafted. The remainder is up to you to establish the relationships with realtors/agents.
