I have a competitor in violation of the Lanham Act

One of my competitors has been selling products made in China for the Past 3+ years (about $15 to $20 million in sales) in a box with an American Flag on the box that states in small letters under it ''In God We Trust 9-11-01.'' The products have no other markings of any Country of origin.

The question becomes, what do you want to do about it? Do you want to try to shut them down? Do you want to obtain an injunction from producing without appropriate labeling?

The problem that you need to be aware of is simply one of cost. Attorneys fees in unfair competition litigation can be costly. Attorneys fees MIGHT be recoverable from the other side after trial.
