Legal Question in Business Law in California

copyright

Need to file copyright on a moving and storage system kit which I am going to market. My kit includes system instructions and inventory aids using a color-coded format. Question: Does this fall under copyright protection or some other protective registration? Have been working with SCORE under SBA but still can't get definitive answer to the exact category my product comes under for protection. Am ready to go- would appreciate answer asap. Thank you.

Re: copyright

Sounds like you have a patent issue (protecting the idea) but you also may have a copyright issue as well (protecting your authoriship of the instructions, etc.) I do copyright and trademarks, but not patents, so I can not tell you the ins-and-outs of patents (although I have a reciprocal relationship with a patent attorney for those issues). However, if you want to discuss the copyright issues (and trademark/servicemark issues if those are applicable to your situation), I would be happy to discuss at no cost. I can also hook you up with my patent attorney friend if you like.

Re: copyright

A copyright is a basic protection but it sounds more like a business methods patent if it is unique enough. WATCH OUT. Patents can only be filed up to 1 year after it's initial disclosure. Contact me should you wish to file the patent. I am a registered patent attorney located in southern california.

Good Luck
