Copyright protected photographs

I am the owner and operator of an online stock photography and image bank that represents photographers from all over the world. Canz is a medium sized Stock Bank

That has an online library of just over 10,000 images. I am writing to see what it would entail to begin legal proceedings against a small commercial enterprise that has downloaded and is presently using an image that we represent without permission.

I am unsure what you would want to know. It does appear you should do something so that this person and others does not harm you, or make the value of your clients' images less valuable or even go into the public domain.

First send a Cease and Desist letter..if that does not work..you have to initiate litigation.

It depends upon whether you have a registered copyright in the image. If you do, then it will only take finding an attorney willing to take the case on a contingency basis.

If you have not registered the copyright, then you will have to do so first, and you will have to pay your attorney by the hour because you will have missed the opportunity for statutory damages and attorneys' fees.

numbers of factors which need to be answered before an estimate of the cost --- more importantly how are you going to stop others from doing the same thing when it is so eaisy to just download pictures on the net and use them as you wish!!!!!! if you are sincere and interested call me at 925-945-6000
