Extended Car Warranty

I bought a Buick LeSabre 92 in May of 1999. It had 105,000 miles on it.I also purchased an Extended Warranty 36,000 miles or 36 months.The first week I have the car, the transmission goes out.The Extended Warranty covers it!The car has been in a least 1 a month since for this & that.Now I get a call from the dealership saying they made a mistake when I purchased the Warranty. I am only qualified for a 24,000 or 2 year Warranty and they want me to resign the Warranty contract. What legal rights do I have?

Without seeing the paperwork, I cannot tell you definitively. However, if you paid for the longer warranty, you should be able to keep it. Generally, unilateral (one sided) mistake will not excuse performance of a contract. If the dealer is someone you want to stay on good terms with, perhaps you could negotiate a shorter warranty. Maybe they could give you some money, or perhaps some other consideration such as floormats or other improvements to the car.

Dont sign anything. Tell them you bought a long warrenty and they better honor it. If they dont like it, tell them you will consider a real sweet deal on another car.
