Legal Question in Business Law in California

Gift Certificates

My husband purchased a gift certificate for my birthday last Febuary at a spa for $185.00. I do not want to use this certificate. I read over everything in the papers, and there is nothing about not being able to get a refund. Legally can I get a refund if I am not going to use the gift certificate or are we just out $185.00.

Re: Gift Certificates

Generally, a retailer's gift policy is controlled by the terms and conditions set forth on the gift certificate. Your question indicated the gift certificate was silent on a cash refund. Most merchants will gladly talk to recipients of gift certificates to explore options that may be more appealing. Why don't you contact the retailer and discuss it with them? It may prove far less difficult than trying to force them to refund the money.

Re: Gift Certificates

I would contact the spa and explain your situation to them. Ask to speak with the manager and tell him that your husband purchased a gift certificate for you but you do not wish to use it. In order to keep good customer relations a facility will usually refund a customer's money. If a call doesn't work put it in writing to get your point across. Good luck.
