Legal Question in Business Law in California

hello,

my name is karen.

I am sorry if this is a waste of time, but i would apreciate it alot if someone could explain this to me. please.

I am a house cleaner , a maid. I work only for myself off referls and flyers i put up. i am not a licenced comp. or anything.

i got a call to clean a house , i went , i cleaned the house. The guy actually has his own referl comp. which i think is more the reason why he called me, to see if he could make money refering me as a house cleaner. they keep most of the money for finding the clients and i would put all the gas products the car and hard work... ne ways we talked alittle about it and he gave me 4 houses to go clean. he said latter on we would sign some contracts. we agreed for me to clean his house again next week. I said sure next wek when i clean your house you can pay me for the houses i cleaned and if it works out ok i can sign the contracts. so i cleaned the houses and when it came time to see him again he dint want his house cleaned and he now says that he cant pay me with out the contracts signed first. i have no desire to continue to work with him because it is a business loss for me and it is not in my best interest. i far as i can imagine i cleaned the houses. he owes me the money. Do i have any real obligation to sign any contract with this person ? there was no contract signed or present at the time i did these jobs. why should i sign one now ? dosent he have to pay me ? I offered to give him a reciept but he says it has to be the contract. can anyone help me out a little bit? please 619-322-5293

Well, it looks like you have a oral/verbal agreement that is enforceable...and the outcome will depend upon what facts you can reasoably prove in small claims court. So, at this point, you have a few choices; one, you can email all the facts and circumstances to an attorney of your choice and request that he/she make a phone call for you to see if such a call can get a reasonable response. If that does not work quickly, you will want to file a small claims court action.
