Liability Releases For Alcohol When Sold In Gift Baskets?

Hello, I own a very small business. I create and sell personalized gift baskets, mainly to Realtors, who then pass the baskets on to their clientelle. One of my clients is interested in purchasing baskets containing hard liquor, and I was wondering if it would be wise to make my clients sign a release when I sell baskets containing alcoholic products.

Selling alcoholic beverages in California requires a license from the Alcoholic Beverage Control Board.

You don't say whether you have a license or not, but you'll surely need one to sell gift assortments containing any kind of alcoholic beverage, whether beer, wine or something stronger.

If you have the required license, I suggest that you ask your question about releases to one of the ABC enforcement people.

If you don't have a license, signed papers won't help you a bit, and would only be evidence against you if you're arrested.
