Legal Question in Business Law in California

Money Owed

How do we file a claim against a company that owes us $2000.00? The company is going out of busines. We do have the owners home address. Do we file a lien ourselves? Do we file in small claims?

Re: Money Owed

Small claims would be best for that amount (under $5,000), make sure you name the individuals if there is a claim involving them so that it can actually be collected.

If the money is past due, so that you can assert a breach of contract, you can sue in small claims. Your chances of getting a judgment from small claims on an amount that is not yet in default based on your concern that a breach may occur in the future would be considerably less.
