renewal of judgement

What is an ''application for and renewal of judgement'' for and what are my rights when i receive this form from a debt collector?

Judgements are valid for ten years, then can be renewed. This sounds like the form to renew a judgement.

Mr. Selik is right. Someone has previously sued you and obtained a judgment. That judgment was valid for 10 years and can be renewed indefinitely for successive periods of 10 years each. The Application for and Renewal of Judgment is the form used by the judgment creditor to renew their judgment for another 10 year period.

You should note that judgments continue to accrue interest at the rate of 10% per annum from the date of entry of judgment until paid. Note also that if your creditor is renewing its judgment against you, it may be getting ready to enforce that judgment.

You can object to renewal of the judgment, and should carefully read the form you were served to learn what your rights are. I believe that the window for objecting to the renewal is very short (something on the order of 10 to 30 days from the date of service).

Normally these are hard to oppose, but there are some cases that allow you to fight these if the Plaintiff did not diligently attempt to collect the debt during the past few years. Please call me if you have any questions.
