Should the UCC rules governing auctions apply to items sold on online auction sites, such as eBay? Why or why not? How can you know whether eBay�s auctions are �with reserve� or �without reserve�?

Commercial Code section 2328 is the only UCC provision applying expressly to auctions, and it applies to eBay auctions. A bidder knows whether an eBay auction is with or without reserve by reading the terms of the listing. 99% of them are without reserve these days.
