Legal Question in Business Law in California

Usage of contractors license w/out authorization.

A person used my license # w/out me knowing. The customer was not happy with his work. Now they are taking me to small claims court. What can I do to protect my license? Can I sue the person who did this to me? Both our names are on the paper work, his name is first. Please help me make the right decision on this, I need my license to work, so that I can take care of my family. I can't afford to loose something i've work'ed so hard for.

You have done the right thing by looking for legal help. I have seen a situation where a professional faced losing his license to practice, and then insisted on trying to handle the court proceedings himself without a lawyer. He lost his license and has little prospect of ever getting his license back. You do not want the same thing to happen to you. You can sue the person who used your name, and there are also legal rules governing when an impostor can bind the person whose name he used to a contract.
