Legal Question in Civil Rights Law in California

Photo used on internet

Recently while cruising the net i came upon a gang identification site that had a photo [no names though]of my two sons.this photo may have been confiscated in a parole raid from my house.does this give the police or whoever used the photo the right to do so? neither of my sons gave permission. my one son is incarcerated in a cya facility in stockton, the other one is currently in the middle of a 187 preliminary hearing charged in the murder of someone. these two boys are 19 and 20 years old.

thanks for any responses on this.
