Legal Question in Civil Rights Law in California

I recently purchased a Camaro that was listed as a SS Camaro. After having it for a week some things didnt add up and I ran the VIN finding out that it is actual a Z28 and not a SS. What legal actions can I take with this?

You may be entitled to the difference or get your money back if you can prove the seller made an intentional misrepresentation of material fact (i.e. said it was an SS and he knew it was a Z28). The burden of proof is going to be on you, so make sure you know all of the elements and you can prove them. Pay close attention to the damages you may be entitled to in this case. If the difference in value between a SS and Z28 is huge and you can prove it consider moving ahead. If it is fairly minimal it may not be worth your time.

You will have to consider whether it is worth pursing because there is a chance you could lose even if you have the perfect case prepared. A judge may determine that a Camaro is a Camaro regardless of what letters are on it. A judge may determine that you should have checked into whether it was an SS or a Z28 before you bought it. A judge may determine that the seller did not intentionally misrepresent anything but just did not know and relied on false information.

If you bought the car from a licensed dealer or car expert you chances are better. If you bought it from a 79 year-old widow who was selling her late husband's fixer-upper you are probably out of luck. The judge may take into account the expertise of the parties. The judge is probably not going to hold a little old lady to the same standards as an expert.
